Terms of Service

DriveFly is operated by AFRO INTELLIGENT, a South African private company (registration 2025/025095/07). These terms govern use of the DriveFly software service. The registered office is 4 Riebeek St, Vasco Estate, Cape Town, Western Cape, 7460, South Africa. Contact: hello@drivefly.co.za or +27 67 608 7645. An order or subscription confirmation must display the total price and billing cycle before payment.

The service

DriveFly supplies scheduling, school administration, learner-training, document, location and payment-record tools. DriveFly is not a driving school, licensing authority, payment institution, legal adviser, or guarantor that a learner will pass a test.

School responsibilities

Schools must hold all registrations and permits required by national, provincial and municipal law; verify each instructor’s current certificate, grade, licence codes and expiry; use roadworthy and appropriately insured vehicles; provide lawful consumer terms; and process personal information in compliance with POPIA and PAIA. Schools may not upload information they are not authorised to process.

Accounts and acceptable use

Users must provide accurate information, protect credentials, promptly report compromise and use only authorised accounts. Abuse, unlawful content, credential sharing, security testing without permission and interference with other tenants are prohibited.

Subscriptions, cancellation and refunds

Current prices, taxes, billing period and renewal terms must be shown before payment. A customer may cancel using the support channel stated on the order confirmation. Statutory cancellation, cooling-off, refund and fixed-term rights under the Consumer Protection Act and Electronic Communications and Transactions Act are not excluded. Any fair cancellation charge will be disclosed and applied only where lawful. No clause limits rights that cannot lawfully be limited.

Payments

PayFast or another disclosed payment provider processes online payments. A payment is complete only after valid provider confirmation. Chargebacks, duplicate payments and refunds are handled under the provider rules and applicable law.

Availability and liability

We aim for reliable service but cannot promise uninterrupted availability. Liability is not excluded for gross negligence, fraud, wilful misconduct, death or personal injury caused unlawfully, or any liability that law prohibits us from limiting. Otherwise, liability is limited only to the extent fair, reasonable and lawful.

Termination and data

Material breach may lead to suspension after appropriate notice where practicable. Customers should export required records before closure. Retention and deletion follow the Privacy Notice and applicable law.

Disputes and contact

Contact hello@drivefly.co.za first so we can try to resolve a complaint. Consumers may also approach the National Consumer Commission, relevant provincial consumer authority, Information Regulator, applicable ombud, or a court with jurisdiction. South African law applies.
